Updates to the Kentucky Medical Marijuana Program


Kentucky’s state governor signed two marijuana-related orders into law last week, which is exciting progress for eagerly waiting residents. One executive order has to do with possession of marijuana and will go into effect as soon as January 1, 2023.


Governor Beshear’s executive order on possession of marijuana will allow patients to legally possess up to eight ounces of cannabis, even though the state currently has no dispensaries. This means residents may legally purchase marijuana from an out-of-state dispensary.


Of course, this only applies to patients who have a medical condition that makes them eligible, some of which include PTSD, cancer, and multiple sclerosis. They must also have a certification which shows they have been diagnosed with the condition.


Technically, law enforcement could still pursue action against residents for possession of marijuana even if purchased from another state, but they will be considered pardoned for their offense.


The second executive order signed by Governor Beshear is concerning delta-8 THC, which has been steadily increasing in popularity for years. The sale of delta-8 THC is not really regulated, which is a cause for concern for many.


The governor’s second order will begin the regulation of the distribution and sale of delta-8 THC in order to make sure users are safe.


The executive order which allows patients to access out-of-state dispensaries is certainly a step in the right direction for Kentucky, but there is still a long way to go. Here is what you can do to speed up the process:
