Kentucky's First Medical Cannabis License Lottery

The road to medical marijuana in Kentucky has been long and complex, but the state is on the cusp of a significant milestone. On October 28, 2024, the state will hold its first lottery for medical marijuana business licenses, marking the next big step in the rollout of the state’s medical marijuana program. This event will determine which businesses will cultivate and process medical marijuana, ultimately shaping the future of Kentucky’s marijuana industry.


The Importance of the October 28 Lottery

The lottery system is designed to ensure fairness in the allocation of business licenses. A total of 4,998 applications have been submitted, and the state is using this method to avoid favoritism and ensure that all qualified applicants have an equal shot at securing a license. The Kentucky Lottery Corporation will conduct the drawing, which will be live-streamed to the public for transparency.


The October 28 lottery will focus on awarding licenses for cultivators and processors. These two types of licenses are crucial for getting Kentucky’s medical marijuana program up and running. Cultivators will be responsible for growing marijuana plants, while processors will turn those plants into usable medical products like oils, tinctures, and edibles.


Licenses for dispensaries, where patients will eventually purchase their medical marijuana, are expected to be awarded through a separate lottery in November.


Pioneering Safety Compliance

In a parallel development, Governor Andy Beshear recently announced that KCA Labs in Nicholasville became the first business licensed under the medical marijuana program. KCA Labs, which has been operational since 2019 and has 2,000 clients globally, is a safety compliance facility. 


This means that they are responsible for testing all medical marijuana products before they are made available to patients. Safety compliance facilities, unlike cultivators and processors, are not subject to the lottery, and there is no cap on the number of these licenses the state can issue.


Kentucky’s medical marijuana program is set to officially launch on January 1, 2025. The October 28 lottery is a critical step toward ensuring that the infrastructure for the program is in place by that date. Kentucky lawmakers passed legislation in 2023 to legalize medical marijuana for patients suffering from a range of qualifying conditions, including cancer, multiple sclerosis, chronic pain, epilepsy, and post-traumatic stress disorder (PTSD).


While the program will not go into effect until 2025, the state is currently allowing limited patient access to marijuana through an executive order signed by Governor Beshear. Under this executive order, patients who meet specific criteria may receive pardon protections for possessing marijuana, but marijuana remains otherwise illegal and unavailable for purchase in Kentucky. The full medical marijuana program will be Kentucky’s first legal pathway for patients to obtain marijuana products.


What Kentucky’s Medical Marijuana Program Will Look Like

Once Kentucky’s medical marijuana program is fully operational, patients with certain qualifying medical conditions will be eligible to receive a medical marijuana card. Some of the key conditions include:


  • Cancer

  • Epilepsy

  • Chronic Pain

  • Multiple Sclerosis

  • PTSD


Patients with these and other approved conditions will be able to possess up to 8 ounces of medical marijuana at any given time, ensuring they have access to enough medicine to manage their symptoms effectively. This quantity is consistent with medical marijuana laws in other states and is intended to meet the needs of patients without overstepping the boundaries of medical use.


The Executive Order and What It Means for Patients

While Kentucky’s full medical marijuana program won’t launch until 2025, the executive order currently in place allows patients to possess marijuana without the fear of being prosecuted, as long as they meet certain requirements. This is a temporary measure designed to provide some level of protection for patients while the state finalizes the rollout of its full program.


Under the executive order, patients must meet one of the following criteria:

  • They must possess medical documentation showing that they suffer from a qualifying condition.

  • They must have proof of purchase from a licensed medical marijuana dispensary in another state where medical marijuana is legal.


While this order does not allow patients to purchase marijuana within Kentucky, it does offer legal protections if they acquire it from another state and meet the specified criteria.


What Patients Can Expect

As Kentucky moves toward the January 1, 2025 launch date for its medical marijuana program, patients are encouraged to stay informed and begin preparing for the application process. This will involve obtaining a recommendation from a licensed physician and submitting an application for a medical marijuana card.


Once the program is operational, medical marijuana will be available only to those with a valid medical marijuana card, meaning patients must take proactive steps to ensure they are prepared to access the new system. Additionally, since marijuana will only be available for medical use in Kentucky, it is critical that patients understand the legal requirements and restrictions of the program to avoid any potential legal issues.
