
As of January 1, 2025, Kentucky's medical marijuana program is operational, and will soon provide patients with qualifying medical conditions access to medical marijuana. A significant concern has emerged: the conflict between state medical marijuana laws and federal firearm regulations. Kentucky lawmakers are actively addressing this issue to protect the Second Amendment rights of medical marijuana patients.
Launch of Kentucky's Medical Marijuana Program
The journey toward legal medical marijuana in Kentucky culminated with the signing of Senate Bill 47 by Governor Andy Beshear on March 31, 2023. This legislation established a comprehensive medical marijuana program, which officially began on January 1, 2025.
Patients diagnosed with conditions such as cancer, chronic pain, epilepsy, multiple sclerosis, chronic nausea, or post-traumatic stress disorder are eligible to apply for medical marijuana cards. The application process involves obtaining a written certification from an authorized practitioner. That’s where we come in! As of February 2025, over 2,200 medical marijuana cards have been approved, with more applications under review.
Federal Firearm Regulations and Medical Marijuana Use
Despite state-level legalization, federal law continues to classify marijuana as a Schedule I controlled substance. The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) has stated that individuals who use marijuana, including for medical purposes, are prohibited from purchasing or possessing firearms. This federal stance creates a dilemma for patients who rely on medical marijuana for health reasons but also wish to exercise their Second Amendment rights.
In response to this conflict, Kentucky lawmakers have introduced a bipartisan concurrent resolution urging Congress to amend the Gun Control Act of 1968. The proposed amendment seeks to allow medical marijuana users to purchase and possess firearms legally.
The resolution emphasizes that citizens should not be forced to choose between essential medical care and their constitutional rights. Governor Beshear has expressed strong support for this initiative, highlighting the injustice faced by patients, including veterans with PTSD, who are denied their Second Amendment rights due to their legal use of medical marijuana.
The Importance of Obtaining a Medical Marijuana Card
For Kentucky residents considering medical marijuana as a treatment option, obtaining a medical marijuana card is essential. This card provides legal protection, granting authorization to possess and use medical marijuana within Kentucky’s regulations. Without it, individuals may face legal consequences, as recreational marijuana remains illegal in the state.
Additionally, having a medical marijuana card will ensure access to licensed dispensaries once they become operational. While dispensaries have not yet opened, they are expected to launch soon, and only cardholders will have the legal right to purchase medical marijuana products from these state-regulated establishments. This guarantees that patients receive safe, high-quality products that meet state standards.

Current Status and Future Outlook
As of February 2025, patients can be seen at either of our medical offices in Louisville and Lexington for in-person appointments to obtain their medical marijuana certifications. While dispensaries are not yet open, the state is actively working to license and establish these facilities. In the interim, patients with a valid medical marijuana card are permitted to obtain medical marijuana from out-of-state sources, though transporting marijuana across state lines remains a federal offense.
The conflict between state medical marijuana laws and federal firearm regulations presents a significant challenge for patients in Kentucky. However, through legislative efforts and advocacy, there is a concerted push to protect the rights of medical marijuana patients, ensuring they do not have to choose between their health and constitutional rights.
